OHM Fitness LLC, OHM Fitness Franchise, LLC, Ohm At Home LLC, OHM Fitness Studios, our affiliated OHM Fitness locations, and our related products, services, websites, applications, and programs (collectively, “OHM Fitness,” “we,” “us,” or “our”) respect your privacy.

This Privacy Policy applies to OHM Fitness services, including our websites and the following mobile applications:

OHM at Home, our legacy mobile application that supports compatible OHM V1 suits and batteries, including the Android application identified by package name com.emsfit.way8.online.newVersion.OHM_AT_HOME; and
Ohm, our current mobile application that supports compatible OHM V2 suits and batteries, including the Android application identified by package name com.ohm.app.

This Privacy Policy explains how we access, collect, use, disclose, share, retain, delete, and protect information when you visit our website, use either mobile application, connect compatible OHM equipment, purchase products, manage a membership or subscription, book or attend services, visit a studio, participate in programs, interact with our advertisements, or otherwise interact with OHM Fitness.

By using OHM Fitness services, you acknowledge the handling of information as described in this Privacy Policy. Where required by applicable law, we will obtain your consent before collecting, using, or sharing information for a particular purpose.

1. Information We Collect

Depending on how you interact with OHM Fitness, we may access, collect, receive, or process the following categories of information:

Name, email address, phone number, and other contact information
Billing address, shipping address, and delivery information
Account identifiers, login information, authentication credentials, and authentication tokens
Payment-related and transaction information processed by our payment providers
Membership, subscription, entitlement, purchase, order, appointment, booking, and class information
Studio location and service preferences
Fitness and workout information generated through our services, such as workout sessions, selected programs or modes, session duration, intensity settings, minutes used, available workout minutes, and participation history
Connected-equipment information, such as compatible OHM equipment type, device identifier, model or version, connection status, battery status, and technical information needed to connect to, operate, support, or troubleshoot the equipment
Customer service inquiries, feedback, and communications
Marketing preferences, communication preferences, and consent records
Advertising interactions and attribution information
Device, application, and technical information, such as device type, operating system, application version, IP address, language, time zone, browser type, log information, crash data, diagnostics, and performance information
Cookie identifiers, advertising identifiers, analytics information, and website or application usage information
Bluetooth and nearby-device information needed to discover, connect to, and communicate with compatible OHM suits and batteries
Location information when you grant permission and a feature requires it, including when certain versions of Android require location permission to discover nearby Bluetooth devices
Other information you voluntarily provide to us

2. Mobile Applications and Connected OHM Equipment

OHM at Home — V1 Compatibility

The OHM at Home application is our legacy application for compatible OHM V1 suits and batteries. It may process account and authentication information; membership, subscription, entitlement, and available-workout-minute information; workout session and usage information; connected-equipment information; Bluetooth or nearby-device information; and device, application, diagnostic, and support information.

Ohm — V2 Compatibility

The Ohm application is our current application for compatible OHM V2 suits and batteries. It may process account and authentication information; membership, subscription, entitlement, and available-workout-minute information; workout session and usage information; connected-equipment information; Bluetooth or nearby-device information; and device, application, diagnostic, and support information.

How the Applications Use Information

We use information handled through the OHM at Home and Ohm applications to:

Create, authenticate, and manage user accounts
Confirm membership, subscription, entitlement, and workout-minute availability
Deliver and record workout sessions and calculate or synchronize minutes used
Discover, connect to, and communicate with compatible OHM suits and batteries
Display equipment connection, battery, and operating status
Provide onboarding, customer service, and technical support
Maintain application security, prevent misuse, and protect user accounts
Diagnose crashes, connection issues, and other technical problems
Monitor performance and improve application and equipment functionality
Comply with legal obligations and enforce applicable agreements

Bluetooth, Nearby Devices, and Location Permissions

Both applications use Bluetooth to discover and connect to compatible OHM equipment. Depending on your Android version, Android may require Bluetooth, Nearby Devices, or location permission before an application can scan for or connect to nearby Bluetooth devices. When location permission is required solely for Bluetooth discovery, we use that permission for the purpose of discovering and connecting to compatible OHM equipment, not to track your movements.

You can manage these permissions through your device settings. If you disable a required permission, the application may be unable to discover or connect to your OHM suit or battery.

Application Service Providers

Information from the applications may be processed by service providers that support hosting, infrastructure, authentication, membership management, communications, analytics, crash reporting, security, customer support, or other functions needed to operate and improve the applications. These providers may process information only as permitted by their agreements with us, their applicable terms, and applicable law.

We do not sell personal or sensitive user data collected through the OHM at Home or Ohm applications for monetary consideration.

3. How We Collect Information

We may collect information directly from you when you:

Create or register an account
Sign in to or use our website or mobile applications
Connect compatible OHM equipment to a mobile application
Start, complete, or otherwise participate in a workout
Purchase products, memberships, subscriptions, packages, or services
Book or attend classes, appointments, events, or programs
Complete onboarding or registration
Submit forms, surveys, reviews, feedback, or inquiries
Contact customer support
Opt in to marketing communications
Interact with our advertisements
Interact with OHM Fitness in-studio, online, by phone, by email, or by text message

We may also collect information automatically through application functionality, device permissions, server logs, cookies, pixels, tags, web beacons, software development kits, analytics tools, crash-reporting tools, advertising technologies, and similar technologies.

We may receive information from OHM Fitness franchise locations, service providers, ecommerce platforms, payment processors, booking and membership systems, customer relationship management platforms, advertising and analytics platforms, fulfillment and shipping providers, and other business partners where permitted by applicable law.

4. How We Use Information

We may use information to:

Provide, operate, maintain, secure, and improve our websites, applications, equipment, studios, products, memberships, programs, and services
Create, authenticate, and manage accounts
Process purchases, payments, subscriptions, orders, returns, shipments, bookings, appointments, and memberships
Provide onboarding, customer service, technical support, and account assistance
Personalize your experience with OHM Fitness
Provide fitness, workout, connected-equipment, membership, and service functionality
Send service-related, transactional, security, or account communications where permitted
Send marketing communications when you have opted in or where otherwise permitted by law
Measure and analyze website, application, advertising, and campaign performance
Understand how customers discover, engage with, and purchase from OHM Fitness
Measure advertising conversions and attribute purchases, registrations, memberships, and other actions to advertising campaigns
Create and manage advertising audiences where permitted
Improve and personalize advertising and marketing efforts
Analyze trends, usage, performance, and customer engagement
Develop and improve our products, services, customer experiences, and business operations
Protect against fraud, unauthorized activity, security incidents, and misuse of our services
Enforce our agreements and policies
Comply with legal, regulatory, accounting, tax, and contractual obligations

5. How We Share Information

We may disclose or share information with service providers and business partners that help us operate, secure, support, and improve our business. These may include providers supporting:

Website, application, cloud, and data hosting and infrastructure
Account authentication and security
Connected-equipment functionality and technical diagnostics
Ecommerce and order management
Payment processing
Order fulfillment and shipping
Memberships, subscriptions, entitlements, bookings, and scheduling

Customer service and technical support
Email and permitted messaging services
Application analytics, crash reporting, and business intelligence
Advertising, attribution, audience management, and marketing measurement

These providers may process personal information on our behalf or as otherwise described in their applicable terms and privacy policies. We require service providers to handle information in accordance with applicable law and appropriate contractual restrictions.

We may also share information with OHM Fitness franchise locations and affiliated entities when reasonably necessary to provide services, manage memberships, support customer relationships, operate studios, fulfill requests, administer programs, and conduct legitimate business operations.

We may disclose information when required or permitted by law, regulation, legal process, or government request, or when reasonably necessary to protect the rights, property, safety, and security of OHM Fitness, our customers, our users, or others; detect or prevent fraud; enforce our agreements; or investigate potential violations.

We may share or transfer information in connection with a merger, acquisition, financing, reorganization, bankruptcy, sale of assets, or similar business transaction.

Text messaging originator opt-in data and consent will not be shared with any third parties, excluding aggregators and providers of the Text Message services.

6. Data Retention

We retain personal information only for as long as reasonably necessary to provide services, operate and secure our business, maintain appropriate records, comply with legal and regulatory obligations, resolve disputes, enforce agreements, prevent fraud, and support legitimate business purposes. Retention periods may vary depending on the type of information, the service involved, and applicable legal or contractual requirements.

If you close or delete an account, we will delete or de-identify personal information associated with that account, except information we are required or permitted to retain for legal, regulatory, security, fraud-prevention, transactional, recordkeeping, dispute-resolution, contractual, or other legitimate business purposes. Information retained for these purposes will no longer be used to provide the deleted account, except where necessary for the permitted retention purpose.

7. Account and Data Deletion

Users of OHM at Home and Ohm may request deletion of their application account and associated personal data. You may initiate a request through an account-deletion control made available within the application or by using the external process below.

Email info@ohmfitness.com with the subject line OHM App Account Deletion Request.
Identify whether your request concerns OHM at Home, Ohm, or both applications.
Provide the email address associated with your account and your full name.
State whether you want your entire account deleted or only specific personal data deleted.

We may take reasonable steps to verify your identity and confirm the scope of the request before completing deletion. Deleting an application account may remove access to memberships, entitlements, saved preferences, workout history, and other application features associated with that account. If the same credentials are used across more than one OHM Fitness service, we will confirm whether your request applies only to an application account or to your broader OHM Fitness account.

After verification, we will delete or de-identify the account and associated personal information, subject to information we must or are permitted to retain for legal, regulatory, security, fraud-prevention, transactional, recordkeeping, dispute-resolution, contractual, or other legitimate business purposes.

Requests to access, correct, or delete personal information that do not require deletion of the entire account may also be submitted using the same email address.

8. Protecting Information

We use reasonable administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, loss, misuse, alteration, or disclosure. Depending on the system and service involved, these safeguards may include encryption in transit, authentication, access controls, monitoring, and other security measures.

Payment information transmitted through our payment providers may be protected using encryption and other security technologies provided by those services. However, no method of transmission over the Internet or electronic storage is completely secure, and we cannot guarantee absolute security.

9. Marketing SMS Communications

If you voluntarily opt in, OHM Fitness may send you recurring automated marketing text messages at the mobile number you provide. Marketing text messages may include exclusive offers, member promotions, fitness tips and inspiration, product launches, special events, and announcements.

Marketing SMS consent is optional and is not a condition of purchase, membership, account creation, or use of OHM Fitness products or services.

Message frequency varies. Message and data rates may apply. You may opt out at any time by replying STOP. You may reply HELP for help.

If you opt out, you may receive one final text message confirming your unsubscribe request. You may opt back in by texting START to +1 (480) 605-9534 or by completing a new Marketing SMS opt-in form.

Marketing SMS communications are separate from transactional or service-related communications that may be sent through other systems or platforms.

10. SMS Consent and Data Sharing

We may collect and store records of your Marketing SMS consent, including your phone number, opt-in method, opt-in date and time, consent language shown to you, and related interaction history.

Text messaging originator opt-in data and consent will not be shared with any third parties, excluding aggregators and providers of the Text Message services.

We may use service providers, aggregators, carriers, messaging platforms, CRM systems, and compliance tools to deliver and manage text message services. These providers are permitted to use SMS-related information only as needed to provide, support, secure, and comply with applicable messaging services and legal requirements.

The advertising and analytics disclosures elsewhere in this Privacy Policy do not authorize us to share text messaging originator opt-in data or SMS consent with third parties for their own advertising or marketing purposes.

11. Email Marketing Communications

We may send marketing emails about OHM Fitness products, services, memberships, promotions, events, content, and updates when you have consented or where otherwise permitted by law.

You can opt out of marketing emails at any time by using the unsubscribe link in our emails or by contacting us.

Even if you opt out of marketing emails, we may still send transactional, service-related, security, or account communications where permitted by law.

12. Cookies, Pixels, Analytics, and Advertising Technologies

We and our service providers may use cookies, pixels, tags, web beacons, software development kits, analytics tools, advertising technologies, and similar technologies to operate our services, remember preferences, understand usage, improve performance, diagnose technical issues, measure advertising effectiveness, attribute conversions, create audiences, and provide more relevant content and advertising.

These technologies may collect information such as your IP address, device and browser information, application version, pages or screens viewed, links clicked, referring pages, interactions with advertisements, purchases, registrations, and other actions taken on our website or applications.

You may be able to manage cookies and similar technologies through your browser, device, application, or available cookie and privacy controls. Blocking certain technologies may affect the functionality of our website, applications, or services.

13. Google Advertising, Analytics, and Customer Matching

We use Google services, which may include Google Ads and related Google advertising, analytics, measurement, and audience tools, to understand how our advertising performs, measure conversions, reach relevant audiences, and improve our marketing.

Where permitted by applicable law and consistent with your choices and consent, we may provide Google with certain customer or contact information for advertising measurement, conversion tracking, attribution, audience creation, and customer matching. This information may include identifiers such as your email address, phone number, name, address, and advertising or click identifiers.

Information provided for certain Google advertising features may be transformed or hashed before or during transmission where supported by the applicable technology. Google may use the information to determine whether it corresponds to a Google user and to help measure whether an advertisement resulted in a purchase, registration, membership, or other relevant interaction with OHM Fitness.

We may also use information maintained in our customer relationship management systems to help measure advertising conversions and create or maintain advertising audiences. For example, we may use customer or membership information to identify audiences of existing OHM Fitness customers or customers who use particular OHM Fitness products or services.

Our sharing of information with Google is subject to applicable law, our agreements with Google, and Google’s applicable terms and privacy practices.

For clarity, text messaging originator opt-in data and SMS consent are not shared with Google for advertising or marketing purposes.

14. Third-Party Services

OHM Fitness relies on third-party platforms and service providers to support portions of our operations. Depending on the services you use, these providers may support application and cloud hosting, account authentication, connected-equipment functionality, analytics, crash reporting, ecommerce, payment processing, memberships and scheduling, customer support, customer relationship management, communications, advertising, fulfillment, and other business functions.

Information processed by third parties may also be subject to their own terms and privacy policies. We encourage you to review the privacy practices of third-party services with which you interact.

Our websites, applications, emails, advertisements, or services may contain links to third-party websites, platforms, or services. We are not responsible for the privacy practices, security, content, or policies of third parties.

15. Payment Information

When you purchase paid products, memberships, subscriptions, or services, payment information may be provided directly to third-party payment processors. OHM Fitness does not intentionally store complete payment card numbers in its own systems when payment information is processed directly by those providers.

Payment processors maintain their own privacy and security practices and may be subject to payment-card industry security requirements, including applicable PCI-DSS requirements.

16. User Content

If you submit reviews, testimonials, photos, videos, comments, feedback, or other content, we may use that content for business, operational, promotional, and marketing purposes, subject to applicable law and any additional permissions required.

17. Your Privacy Choices and Rights

Depending on where you live and applicable law, you may have rights or choices concerning your personal information. These may include the ability to request access to, correction of, portability of, or deletion of certain personal information; to opt out of certain processing; or to withdraw consent you previously provided.

Some information may need to be retained for legal, security, fraud-prevention, transactional, contractual, recordkeeping, or other legitimate business purposes.

You may opt out of marketing emails by using the unsubscribe link included in those emails. You may opt out of marketing text messages by replying STOP.

You may also be able to manage certain application permissions, advertising, cookie, or tracking preferences through your browser, device, Google account, application settings, or other privacy controls made available by the applicable platform.

To exercise a privacy right, contact us using the information in the “Contact Us” section below. We may need to verify your identity before fulfilling a request.

18. Children’s Privacy

OHM Fitness services are not directed to children under 13. We do not knowingly collect personal information from children under 13. If we learn that we have collected personal information from a child under 13, we will take reasonable steps to delete it.

19. Users Outside the United States

If you access OHM Fitness services from outside the United States, your information may be transferred to, processed, and stored in the United States or other countries where privacy laws may differ from those in your location.

Where required by applicable law, we will take appropriate steps regarding consent, data transfers, and other applicable privacy requirements.

20. Franchise Locations

OHM Fitness studio locations may be independently owned and operated. Franchise locations may collect and use personal information in connection with studio operations, memberships, appointments, classes, customer service, local communications, and related services.

OHM Fitness franchise locations are expected to handle personal information in accordance with applicable law and relevant OHM Fitness policies and requirements.

Depending on the nature of your interaction, a franchise location may independently control certain information collected directly through that location.

21. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our applications, connected equipment, services, business practices, technologies, legal requirements, or other circumstances. When we update this Privacy Policy, we will revise the “Last Updated” date at the top of this page.

Changes become effective when the updated Privacy Policy is posted, unless otherwise stated or required by applicable law.
